These Terms and Conditions (“Terms”) govern your access to and use of TapoPC.com and any related software, applications, downloads, and services (collectively, the “Service”). The Service is described as a CCTV monitoring app that may allow you to view, manage, and monitor compatible cameras and video streams.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1) Who We Are
TapoPC.com,” “we,” “us,” and “our” refer to the operator of the Service. Contact details are provided in Section 16 (Contact).

2) Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service, or have permission from a parent/guardian. By using the Service, you represent that you have the legal capacity to enter into these Terms.

3) The Service (CCTV Monitoring)
The Service may provide features such as:

Viewing live camera feeds
Playback of recordings (where supported)
Device management and settings
Notifications and alerts (where supported)
Important:

The Service may require compatible camera hardware, a local network, and/or third-party services.
We do not guarantee that the Service will work with every camera model, firmware version, router, or network configuration.
4) Account Registration and Security
If the Service requires an account:

You must provide accurate and current information.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity under your account.
Notify us promptly if you suspect unauthorized access or misuse.

5) Acceptable Use
You agree not to:

Use the Service for unlawful purposes or to violate any applicable law
Monitor or record individuals where you do not have the legal right or required consent
Attempt to gain unauthorized access to devices, networks, accounts, or systems
Interfere with or disrupt the Service, servers, or networks
Reverse engineer, decompile, or attempt to extract source code except where prohibited by law
Use the Service to distribute malware or engage in phishing, spamming, or abuse
We may suspend or terminate access if we reasonably believe you violated these Terms.

6) CCTV, Privacy, and Legal Compliance
You are solely responsible for ensuring your use of the Service complies with all applicable laws and regulations, including but not limited to:

Video surveillance and privacy laws
Consent requirements (audio recording often has stricter rules than video)
Workplace monitoring laws
Tenant/landlord regulations
Data retention and disclosure requirements
You agree to post appropriate notices where required (e.g., “CCTV in operation”) and obtain any necessary permissions/consents.

7) Your Content and Data (Video, Images, Recordings)
“User Content” includes camera feeds, recordings, snapshots, metadata, device names, and any other content you upload, store, transmit, or make available through the Service.

You retain ownership of your User Content. However, you grant us a limited, non-exclusive license to process your User Content only as necessary to operate, provide, secure, and improve the Service (e.g., streaming, transcoding, troubleshooting, and performance optimization), subject to our Privacy Policy (if provided).

You represent and warrant that:

You have all rights and permissions necessary to use and share your User Content through the Service
Your User Content does not infringe any third-party rights or violate any laws
8) Storage, Backups, and Data Loss
If the Service includes storage or playback features:

Storage capacity, retention periods, and availability may vary by plan or configuration.
You are responsible for maintaining backups of important recordings unless a paid backup feature explicitly guarantees retention.
We are not liable for loss of data resulting from device failure, network outages, third-party service interruption, misconfiguration, firmware updates, or unauthorized access, except to the extent required by law.

9) Third-Party Services and Hardware
The Service may integrate with or rely on third-party products or services (e.g., camera manufacturers, cloud providers, app stores, notification services). We are not responsible for:

Third-party downtime or failures
Changes in third-party APIs or functionality
Third-party terms, privacy practices, or security policies
Your use of third-party products may be governed by separate terms.

10) Fees, Subscriptions, and Payments (If Applicable)
If the Service offers paid features:

Prices, billing cycles, and plan features will be disclosed at the time of purchase.
Taxes may apply depending on your location.
Subscriptions renew automatically unless canceled before renewal (where applicable).
Refunds: Unless required by law, payments are non-refundable once processed. If a refund policy is offered, it will be shown at checkout or in a separate policy.

We may change pricing or plan features with prior notice as required by law.

11) Intellectual Property
The Service, including its software, design, logos, trademarks, and content (excluding User Content), is owned by us or our licensors and is protected by intellectual property laws.

Upon termination, your right to use the Service ends. Depending on the Service design, you may lose access to certain data or recordings.

14) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

Continuous, uninterrupted, or error-free operation
That alerts/notifications will be timely or delivered
That footage will always be captured, stored, or accessible
That the Service will prevent theft, harm, or property damage
CCTV monitoring is not a substitute for professional security services or emergency response.

15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100 USD IF YOU PAID NOTHING), WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so these may not apply to you.

These Terms are governed by the laws of the jurisdiction where the Service operator is established, unless otherwise required by applicable consumer protection laws.

Where permitted, disputes will be resolved in the courts located in that jurisdiction, unless a mandatory arbitration/consumer forum rule applies in your country.
